The attorney representing Ashli Babbitt’s family plans on filing a lawsuit against the Capitol Police for killing Babbitt during the Jan 6th riots.
“Right now, we have no accountability—zero accountability—they give no explanation to justify the shooting and they do not even identify the officer,” said Maryland-based attorney Terrell N. Roberts III. “That is what they do in autocratic countries, not in the United States.”
Roberts will be suing the police under the Federal Tort Claims Act, which requires a six-month notice before filing a lawsuit in court. The family will also be seeking compensation from the officer who killed Babbitt.
The attorney is viewing cell phone footage of the shooting. He will also not be revealing the officer’s name at this time.
“The purpose of the case is to hold the police officer and the Capitol Police accountable for violating Ashli Babbitt’s constitutional right—that is the purpose,” said Roberts to The Washington Times.
“If we call ourselves a free people, you would think that Congress would be the first to demand transparency of its own police agency but you don’t hear that,” continued Roberts.
Last week, Rep. Paul Gosar (R-AZ) demanded officials identify the officer who “executed” Babbitt during a hearing by the House Oversight and Reform Committee. Gosar said that Babbitt was unarmed and wrapped in an American flag.
Last month, federal prosecutors cleared the officer who shot Babbitt of any wrongdoing. Officials claimed the officer acted in self defense.
