A senior-level officer within the Customs and Border Protection (CBP) revealed a plan to resume catch-and-release of illegal immigrants according to Breitbart News.
The plan would change how immigrants are currently processed by Border Patrol agents. Agents would be required to release illegal immigrants without a Notice to Appear or notifying immigration courts.
“This is insane, it is another pull factor that will overwhelm us,” said an anonymous CBP official to Breitbart News. “We are creating another entirely different class of aliens we will have to deal with years from now. We will never find most of these aliens once they are released.”
The plan would require agents to follow a process called “prosecutorial discretion.” Agents would fill out an arrest report, which is a singular page. Criminal record checks and photographs would also be performed.
Illegal immigrants would also be required to tell officials which city they are traveling to and to report to the nearest immigration court office after arrival, which the source believes is an impossible task.
“If we can’t process them with our staffing of thousands and are being overwhelmed, the minimal staffing of court clerks around the country will never catch up — even if the migrant shows up,” said the source.
Without any formal notice, the illegal immigrants are able to freely travel anywhere they want to around the country and are not placed into the immigration court system. Officials would also not be able to remove illegal immigrants who do not show up to their court dates. This could result in more incentives for migrants to illegally enter the US.
According to the source, the plans are only being implemented in the Rio Grande Valley Sector of the Border Patrol in South Texas, which could result in a large increase in traffic to this specific region.
The plan is designed to decrease migrants currently being detained by the federal government, but the source believes an increase in traffic could cause capacity issues to reemerge.
“We may be reducing the time it takes to release a family unit but if we encourage more to come once they find out it is quicker here, we’ll be in the same boat again,” said the official.
CPB announced that it has encountered more than 100,000 migrants at the border in February alone.
“We are on pace to encounter more individuals on the southwest border than we have in the last 20 years,” said Department of Homeland Security Secretary Alejandro Mayorkas, later claiming that this crisis is “not new” and that the US has experienced similar border spikes in the past.
